Letting Pool Arrangements

Q. Is there a rental programme available for villas in The Ocean Estate?
A. Yes, purchasers will be offered the option to put their villas in a letting pool that will be managed and operated by         Banyan Tree Resorts. There are two options, a Revenue Sharing Management Agreement and a Standard         Management Agreement.

Q. How does the Revenue Sharing Option work?
A. In terms of this option, a purchaser will be allowed to occupy his villa for 60 days during every year, at no cost. A         purchaser will not be required to pay any service charges in respect of the services rendered by the Banyan Tree         Resorts. During this period, the purchaser shall have full access to and use of all the facilities upon certain terms         and conditions.
        For the rest of the year the villa will form part of the letting pool, during which period Banyan Tree Resorts shall pay         rental to the purchaser, which rental is calculated as one third of the net rental revenue received in respect of such         villa.

Q. What are the benefits of the Revenue Sharing Option?
A. Banyan Tree Resorts has undertaken to market the villas on an on-going basis with the aim of ensuring         reasonable levels of occupancy of these villas. Banyan Tree Resorts will use its best efforts to operate a fair         rotation policy for guests booking for the same category of villa.

Q. How do I book my 60 days in the villa?
A. When the purchaser wishes to use his villa, he must notify Banyan Tree Resorts in writing at least 30 days prior to         occupation of his villa.

Q. How does the Standard Option work?
A. In terms of this option, a purchaser will be allowed to occupy his villa for an unlimited period during every year, but         be liable for all costs in relation thereto. However for such period as is specified by the purchaser, the villa may         also form part of the letting pool and Banyan Tree Resorts shall pay rental to the purchaser, which rental is         calculated as one half of the net rental revenue received from the letting pool in respect of his villa. During the         period of occupation by the purchaser, the purchaser shall have full access to and use of all the facilities upon         certain terms and conditions. Banyan Tree Resorts will only let the villa to guests once all other villas which are         subject to the Revenue Sharing Option have been let.

Q. What services will be provided in terms of the Standard Option for which I have to pay?
A. For a fixed fee, Banyan Tree Resorts will provide the following services:

  • provision of security guards
  • housekeeping service
  • gardening service
  • swimming pool maintenance
  • cable television connection
  • monthly pest control of the villa
  • international direct dial (IDD) telephone connection
  • wire and wireless internet access
  • provision of 2 electric powered vehicles (EPV’s), together with repairs and
  • maintenance thereto
  • common area expenses (buggy path lights, desalination plant and generator maintenance, waste removal, landscaping, sewerage treatment, closed circuit television (“CCTV”) maintenance, salaries of appropriate persons in charge)

Q. Will I be able to verify the income received and paid over to me when my villa is in the letting pool?
A. Yes, the calculation of the rental due to the purchaser shall be made monthly and be payable quarterly in arrears.         Purchasers have full access to the books of account for the administration of their villa as part of the letting pool.
